BAC: Blood and Breath Tests

 

In California, persons age 21 and over can be arrested for DUI, if their blood alcohol content (BAC) is over the legal limit, .08 or higher. Under California laws, you are not required to submit to Field Sobriety Tests before an arrest.  However, you are required to submit to a chemical breath or blood test.  Failure of the chemical breath or blood test is ground for driver license suspension.  Sometimes errors can occur in the testing, and a lawyer can seek to dispute the test results to have charges reduced or dismissed.  Refusal to take chemical breath or blood test is ground for a longer driver license suspension.
